1. DOMESTIC (PRIVATE BENEFIT /MIXED BENEFIT FOUNDATION)

Required Details

• Name of a foundation;
• Office address;
• Objectives;
• Initial assets/Initial Capital;
• The term for Establishment;
• Beneficiaries or the procedure for their appointment (s);
• Main activities and other activities;
• Identification and address of Founder (s) or Executor and address;
• Identification and Address of Guardian(s); (Should not be a member of council Art.28);
• Identification and Address of Councilor(s) (at least three members of above 16 Years each and one with residence in Rwanda Art.31);
• Identification and address of Executive Secretary (Should not be a member of council);

Required attachments

• ID/Passport of involved individual person;
• Application form;
• Notarized Foundation charter;
• Medical Certificate and criminal record certificate for Guardian;
• Medical Certificate and criminal record certificate for Councilor;
• Medical Certificate and criminal record certificate for Executive Secretary;
• Certified true copy of Incorporation documents and proof of good standing for corporate members;
• Declaration form of Beneficial Owners.

2. BRANCH OF A FOREIGN FOUNDATION (PRIVATE BENEFIT /MIXED BENEFIT FOUNDATION)

Requirements

The applicant for trust deed/instrument registration must provide:

• Notarized (executed in front of the notary) trust deed of trust instrument;
• ID or passport copies for Trustee(s) and Settlor;
• Notarized Acceptance of trusteeship by trustee (s) in the form prescribed by the Registrar General (accessible on RDB website);
• The license to serve as trustee (issued by CMA for trust governed by the laws relating to capital markets and BNR for other trusts);
• Filled form for beneficial ownership information of the trust;
• ID or passport copies of the beneficial owners of the trust and any other supporting documents proving the ownership or any other control held in the trust.

3. RE-DOMICILIATION OF A FOUNDATION (PRIVATE BENEFIT AND MIXED BENEFIT FOUNDATION)

Required Details

• Name of a foundation;
• Office address;
• Office address of incorporation (Origin);
• Objectives;
• Capital at the time of re-domiciliation;
• The term for Establishment;
• Beneficiaries or the procedure for their appointment (s);
• Main activities and other activities;
• Identification and address of Founder (s) or Executor and address;
• Identification and Address of Guardian(s); (Should not be a member of council Art.28);
• Identification and Address of Councilor(s) (at least three members of above 16 Years each and one with residence in Rwanda Art.31);
• Identification and address of Executive Secretary (Should not be a member of council);

Required attachments

• Application form signed by members of the governing body of the foundation;
• Certified true copy of Certificate of registration of the foundation;
• Certified true copy of Certificate of Current standing of the foundation;
• ID/Passport of involved individual person;
• Notarized Foundation charter;
• Medical Certificate and criminal record certificate for Guardian;
• Medical Certificate and criminal record certificate for Councilor;
• Medical Certificate and criminal record certificate for Executive Secretary;
• Certified true copy of incorporation documents and proof of good standing for cooperate members;
• Declaration form of Beneficial Owners;
• Certified copy of proof of approval of transfer (From the country of Origin).
